The Napster case involving music downloads in violation of intellectual property rights is much like new Vevo, YouTube and Vimeo civil litigation cases involving unauthorised copy-written material in the publication of videos for academic and other purposes on the internet. If I am Shalamar and play one of my videos on YouTube right now, shouldnt I get an immediate payment from YouTube via the recording company with whom I have an intellectual property contract? Most artists are not being paid the percentage they are entitled to contractually in either case although YouTube has gone far enough with the technology to acknowledge the IP and advise the youtube user automatically of the intellectual property rights and the Youtube obligation to pay the artist and the publishing company each time the intellectual property is broadcasted as part of the video.
