A youth in school borrowed money from a class mate when the friend offered. The friend confirmed to the police that he wanted to lend the money to the youth and borrower after the mother of the alleged victim had contacted the Principal of the school and the Principal called the police. The matter ended up in youth Court with the the accused youth and borrower of the money charged with robbery. The elements of robbery were not provable within the facts of the case. The Crown wanted to allege that the boys were too young at 15 to understand the plain meaning of their words or the intent of their words and actions yet they were old enough to qualify as life guards and were only months away from being able to drive a motor vehicle under our laws. There was no reason to impute any issue with comprehension of a robbery vs. lending money to a friend as they were both students in school and capable of being police officers in 4 years as students in a learning difficulty program but not a school for the learning impaired. After our careful submissions, the charges were withdrawn and it was our pleasure to help this West Indian family from Jamaica.
