But, there was sweat on the throttle and it could help if the vehicle could be apprehended, if not the driver, immediately to ensure continuity with the accident that took place allegedly since what if someone else drove the vehicle after the accident took place?   If you find the vehicle hours later, you have doubt and cannot be sure the last and most immediate  driver is the same  driver who committed the offence.  The commission of the offence can be established with the 911 reports from eye witnesses as contemporaneous with the offence that identifies the vehicle with the same improper  plates.  If not, then if the witnesses can not be sure, then the officer cannot be sure and if the officer cannot be sure, how can the Crown prove their case? The Court has something to think about. Maybe Watson from IBM can help. Maybe the real  guilty party pulled over and got some Wall's ice cream and never left the scene really and was only a few doors up da road! The accused who is now in Court quite possibly has no idea what happened.  Drivers licenses and insurance coverage can be proven with contractual evidence available to the accused as a matter of right to  confirm a valid contract of insurance was in place at the time of the accident if they have insurance.
Our condolences are shared with the family whose 75 year old son was injured and it is hoped that the actual perpetrators are apprehended for leaving the scene of the accident.
The other issue is whether the pedestrian has been charged with unlawfully entering the roadway, causing an accident; right Aditomotra?
